TERMS AND CONDITIONS

PLEASE READ: THE 'CONDITIONS OF GYM MEMBERSHIP', THE 'IMPORTANT WAIVER, RELEASE AND INDEMNITY' & 'TERMS OF PAYMENTS' BEFORE ACCEPTING ANY SERVICE PROVIDED BY THE MILL GYM. 

CONDITIONS OF GYM MEMBERSHIP

WHEN I ACCEPT MEMBERSHIP TO THE MILL, I ACKNOWLEDGE & AGREE TO THE FOLLOWING:

  1. to UPHOLD THE GYM’S ETHOS, TRAINING PHILOSOPHY, STANDARDS AND RULES.

  2. I AM RESPONSIBLE FOR MY BEHAVIOUR, CONDUCT, PERFORMANCE, TRAINING AND RECOVERY.

  3. AS A MEMBER. I AM BEING ASSESSED FOR MY AWARENESS AND SAFETY, MY ATTITUDE AND CONDUCT, AND MY STRENGTH & FITNESS, I ACKNOWLEDGE THAT IF I FAIL ANY ONE THESE ASSESSMENTS THEN, AT THE DISCRETION OF THE MILL DIRECTORS, MY MEMBERSHIP TO THE GYM MAY BE REVOKED.

  4. I WILL ALWAYS ENDEAVOUR TO PERFORM THE FUNDAMENTAL TRAINING MOVEMENTS, TECHNIQUES AND METHODOLOGIES TO A HIGH STANDARD

  5. I WILL RE-SIT THE GAC TEST EVERY YEAR (BY THE 31ST OF MARCH) AND PASS TO A MINIMUM LEVEL 3. I UNDERSTAND THAT FAILURE TO RE-SIT THE TEST IN THE SPECIFIED TIME, OR ACHIEVE A MINIMUM LEVEL 3, WILL RESULT IN AN IMMEDIATE RELEGATION TO LEVEL 2 CLASSES AND SERVICES.

  6. If I HAVE PREVIOUSLY HELD MEMBERSHIP (I.E. QUALIFIED TO LEVEL 3), AND HAVE BEEN ABSENT FROM THE GYM FOR A PERIOD OF 3 MONTHS OR MORE, THEN, AT THE DISCRETION OF THE MILL STAFF, I MAY BE REQUIRED TO RE-SIT THE GAC TEST & PASS TO LEVEL 3 BEFORE I CAN ATTEND THE GAC CLASSES.

  7. TO MAINTAIN MY MEMBERSHIP TO THE MILL, I ACCEPT THAT I AM PART OF A HIGH FUNCTIONING TEAM, AND THAT I MUST ALWAYS CONSTRUCTIVELY CONTRIBUTE TO THIS ENVIRONMENT.


IMPORTANT WAIVER, RELEASE AND INDEMNITY

I, as named above, make the following representations: • I have no impairments, illnesses or conditions that might endanger me or others whilst training at The Mill Gym. • I will disclose any impairments, illnesses or conditions that might affect my ability to train at The Mill Gym to a trainer before undertaking any training. • I understand that training at The Mill Gym is extremely mentally and physically demanding and involves significant risks of injury to me and to those training around me which exceed the risks commonly accepted in other sports and physical training environments. • I understand that accidents and injuries resulting from falls, dropped weights or equipment or failed equipment or other causes may happen without fault or negligence on anyone’s part and that serious injury or death may result. • I have read this form carefully and understand that by selecting 'I agree', I am releasing valuable legal rights that I might otherwise have and that I indemnify The Mill Gym from the consequences of my negligent or intentional acts that cause damage or injury. • I willingly assume full responsibility for the risks to which I will be exposed in training at The Mill Gym and in participating in activities organised by The Mill Gym.

Release: In consideration of the foregoing, I, for myself, my heirs, executors, administrators, personal representatives, successors and assigns, waive and release any and all rights, claims and causes of action I have or may have against The Mill Gym or anyone associated with The Mill Gym Pty Ltd and its associates, its agents, employees, officers, directors, successors and assigns that may arise as a result of my participation in The Mill Gym classes or events and any pre and post class events activities. I acknowledge that in providing this release I am not relying on any representations made by or on behalf of The Mill Gym and do so of my own free will. Further, I grant full permission to The Mill Gym to use any photographs, motion pictures, recordings, or any other record of these classes or events for any legitimate purpose including commercial advertising. If I am signing on behalf of a minor child, I also give full permission for any person connected with The Mill Gym to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well-being of the child.

Indemnification: I recognise that there is risk involved in the types of activities offered at The Mill Gym. I accept liability for any injury that I may cause either to me or to any other participant due to my negligence, or my intentional acts or omissions. I agree to indemnify and hold harmless The Mill Gym Pty Ltd, its principals, directors, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while training at The Mill Gym or whilst engaging in activities offered by The Mill Gym Pty Ltd. I have read and understood the foregoing acknowledgment of risk, release of liability and indemnity prior to signing it and that it shall be binding upon my heirs and assigns.

By clicking on 'I agree' below, I have read and understood the foregoing Waiver, Release and Indemnity and I understand that by checking this box, it obliges me to indemnify the parties named in respect of liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission. I understand that by checking this box I am waiving valuable legal rights.


TERMS OF PAYMENT

We (The Mill Gym) are not required to provide a refund:

i) if you change your mind about the products or services you asked for; or

ii) if the event is postponed or cancelled due to government restrictions including restrictions on public gatherings; or

iii) if the event is postponed or cancelled due to force majeure in the locality of the provision of this service.

Upon selecting 'I accept' and by completing this purchase I accept that The Mill Gym does not provide any refund for this product or service if:

a) I change my mind;

b) I cannot attend for any reason. This includes due to injuries or illness or government restrictions; and/or

c) or for any of the circumstances described below.

I accept that if I need to cancel a service (program, workshop or camp etc.) set for a specific date, then the paid fee will be held in credit for me to use at the next available like-service. This credit will remain for 12-months from the date of payment.

I may choose to cancel my contract for a service, and receive a refund for unconsumed services, if the service that was provided has a major problem.

A major problem is when the service/product:

a) Has a problem that would have stopped someone from purchasing the service if they had known about it

b) Is substantially unfit for its common purpose, and can’t easily be ­fixed within a reasonable time

c) Does not meet the specifi­c purpose you asked for and cannot be easily rectified within a reasonable time

d) Creates an unsafe situation

If the problem with a service provided is not major, the Mill Gym will attempt to fi­x it within a reasonable time. If the problem cannot be ­fixed, the Mill view it as a major problem.

Camps, workshops, services and service packages are not transferable to other individuals or clinics.
